2.1. These Terms apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 ("the CPA") and contain provisions that appear in similar text and style to this clause and which –
2.1.1.1. may limit the risk or liability of Mitzuma or a third party; and/or
2.1.1.2. may create risk or liability for you; and/or
2.1.1.3. may compel you to indemnify Mitzuma or a third party; and/or
2.1.1.4. serves as an acknowledgement, by you, of a fact.

2.3. Nothing in these Terms is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or Mitzuma in terms of the CPA.
3.1. Only registered users may purchase Products on the Website.
3.2. To register as a user, you must provide a unique username and password and provide certain information and personal details to Mitzuma. To purchase Products, you must first enter the Website using your unique username and password.
3.3. You undertake to make sure that no third party is given access to your access codes, and you will notify us right away of any actual or suspected unauthorized use or access to them.
3.4. By using the Website you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.

4.1. Mitzuma will only accept returns in accordance with this policy, the Consumer Protection Act 68 of 2008, the Electronic Communications & Transactions Act 25 of 2002 and any other applicable law.
4.2. Please refer to our Returns Policy for more information about returning products (and related refunds, replacements or repairs). The Returns Policy is incorporated by reference (which means that it forms part of these Terms and Conditions).
5.1. We are committed to providing secure online payment facilities. A suitable encryption method is used to encrypt every transaction.
5.2. Payment can be made using the following options-
5.2.1. Debit/Credit card payments: We only accept MASTERCARD and VISA credit and debit cards. We will debit the total value of your online order against the payment card tendered by you during the check-out process;
5.2.2. Instant EFT, Snapscan, Zapper, Apple Pay & Samsung Pay via Payfast;
5.2.3. Instant EFT Ozow; and
5.2.4. Payflex.

5.4. Once you have selected your payment method, you will be directed to a link to a secure site for payment of the applicable purchase price for the Goods.
6.1. Mitzuma provides you with two options for delivery. You can choose to have delivery made by:
6.1.1. Courier; or
6.1.2. Self-collection (Pargo Pick Up Points)
6.2. Delivery times are estimated times only and we are not liable for any late deliveries.
6.3. Please refer to our FAQs for specific information on ("Shipping and Delivery")
6.4. Mitzuma is not responsible for any loss or unauthorised use of a product once it has been delivered to the physical address you have designated.
7.1. We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of products on the Website. However, should there be any errors of whatsoever nature on the Website (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid, or otherwise as set out in the Returns Policy.
8.1. Mitzuma respects your privacy and is committed to the protection of the personal information of Users in compliance with the Promotion of Access to Information Act 2 of 2000 (“PAIA”) and the Protection of Personal Information Act 4 of 2013 (“POPIA”).

11.1. Mitzuma provides a 6-month warranty on all products sold on the website against defects or poor quality from the date of delivery. We cannot facilitate any returns outside of this 6-month period.
11.2. The products we supply can only be utilized for the purposes for which they were intended. You must also make sure the products are handled, stored, installed, worn, and otherwise handled in a normal and reasonable manner, and where necessary, in accordance with the instructions provided at the time of purchase.
11.3. Should you use the Products in breach of these terms and conditions, we are not responsible for any actions or claims for injury or damages of any kind.
12.1. Mitzuma may, at its sole discretion, change this agreement or any part thereof at any time without notice. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes.
12.2. If you use the Website after such amended Terms and Conditions have been displayed on the Website, you will be deemed to have accepted such changes.
13.1. Stocks of all goods on offer are limited. Mitzuma shall take all reasonable efforts to discontinue the offer as soon as stock is no longer available. However, should items still be offered after stocks are sold, Mitzuma shall only be liable to refund monies where it is unable to fulfil orders at advertised prices.
